Opcijske pogodbe so pogodbe, s katerimi subjekti, ki želijo prevzemati tveganja, ta tveganja prevzemajo od strank, ki se želijo tem tveganjem izogniti. Opcijske pogodbe so se razvile v Združenih državah Amerike na področju kmetijskih izdelkov, sedaj pa so se razširile tudi na druga področja. V Republiki Sloveniji opcijske pogodbe niso posebej zakonsko urejene. Omenja jih samo zakon o trgu finančnih instrumentov. Zato je treba opcijske pogodbe interpretirati po določbah obligacijskega prava. Prispevek je poskus uvrstitve opcijskih pogodb v pravni sistem Republike Slovenije.

Options are contracts which allow the transfer of risk from the subjects who want to avoid the risk to the subjects who are willing to bear the risk. Option contracts first developed in the US in the field of agricultural products; now they can be found in all fields. In legislation of the Republic of Slovenia, option contracts are not specifically regulated. The term is only mentioned in the Market in Financial Instruments Act. Therefore, option contracts shall be interpreted according to the general principles of contract law and law of obligations. The article is an attempt to locate option contracts within the legal order of the Republic of Slovenia.
